For the purposes of this Charter, unless the context otherwise requires, the following words and expressions, whether singular or plural, shall have the meaning set forth below:
“ZEPHALTO”, a company with capital of 1042.10 euros, whose registered office is registered in the Montpellier Trade and Companies Register under number 824 029 516, whose registered office is located at Domaine de l’Estang – 34 230 LE POUGET.
“Charter” means this Privacy Policy;
“CNIL” means the National Commission for Information Technology and Civil Liberties;
“Personal Data” means personal information concerning the User of the Site;
“GDPR” means General Data Protection Regulation 2016/679 of 27 April 2016;
“Site” means the site accessible at the address industry.zephalto.com;
“Processing” collectively refers to the management, collection, protection and storage of the User’s Personal Data;
“User” means the user of the Site, whether a customer or a simple visitor to the Site.
ZEPHALTO has implemented this Charter so that the User can communicate his Personal Data in compliance with a strict confidentiality and security policy by which ZEPHALTO undertakes to protect his privacy and to manage his Personal Data in a fair and transparent manner.
1. Data controller
In order to ensure the proper application of its commitments as the controller of the Personal Data collected on the Site in accordance with the GDPR and the Data Protection Act in its latest version in force, ZEPHALTO has appointed a data protection officer in charge of information and advice on the protection of Personal Data who can be contacted by email at: contact@zephalto.com
2. Category of Personal Data collected
ZEPHALTO informs the User that it may collect or obtain the Personal Data communicated by the User when ordering on the Site (for example, via a form on the Site) or if their Personal Data is accessible to the public.
ZEPHALTO may also collect or obtain Personal Data from the User by noting or deducing this data from the way he or she interacts directly with ZEPHALTO or indirectly through other people (for example, partners, co-data controllers or subcontractors, who could participate in Personal Data collection operations in the name and on behalf of ZEPHALTO).
The Personal Data collected or obtained by ZEPHALTO on the Site may be: title, surname, first name, email address, telephone number, postal address, company.
3. Nature and purpose of the Processing
ZEPHALTO will use Personal Data to process User requests, manage its “customer” file, and send commercial and/or promotional offers to the User.
The data required by ZEPHALTO are indicated by an asterisk in the forms. If this mandatory data is not provided, the User’s request cannot be validated. Other information, the provision of which is optional, is intended to better understand the User in order to improve the services offered to them.
Failure to provide this optional data will not prevent the User from validating the order.
If the User no longer wishes to receive commercial and/or promotional offers from ZEPHALTO, he/she can unsubscribe by sending an email to contact@zephalto.com or by clicking on the link provided for this purpose in the emails presenting these offers.
4. Recipients of Personal Data
ZEPHALTO may be required to communicate Personal Data in the event that such disclosure is required by law, an administrative authority or for the purposes of legal proceedings.
5. Security of Personal Data
ZEPHALTO takes all necessary precautions, including organizational, technical, software and physical measures in terms of digital security to protect the User’s Personal Data against any loss, theft and fraudulent theft, as well as against any unauthorized access, disclosure, alteration or destruction of Personal Data.
However, it should be noted that the Internet is not a completely secure environment and the Site cannot guarantee the security of the transmission and storage of information on the Internet.
ZEPHALTO implements all useful measures with regard to the nature of the data collected and the risks presented by the Processing, to preserve the security of Personal Data and, in particular, to prevent them from being distorted, damaged, or accessed by unauthorized third parties.
6. User rights
In accordance with national and European law, the User is entitled to exercise the following rights with ZEPHALTO, which carries out Processing of his Personal Data:
– to be informed of the existence and purposes of any Processing of their Personal Data
– to access their Personal Data and request their rectification or deletion or even a limitation of the Processing;
– to oppose the Processing of his/her Personal Data and to request their portability;
– to withdraw, at any time, his consent given to ZEPHALTO concerning his Personal Data;
– to promptly inform the data protection officer of any loss or fraudulent theft (illegal processing) of their Personal Data.
To exercise these personal rights, the User may send a request by email to contact@zephalto.com, in accordance with this Charter on the protection of personal data.
In the event of dissatisfaction with the way in which ZEPHALTO has managed Personal Data or for any question or request raised and which has remained unsuccessful, the User is entitled to lodge a complaint with the CNIL.
7. Duration of retention of Personal Data
The User’s Personal Data will be kept by ZEPHALTO for the longest period among the following: (i) the period necessary for the completion of the following operations: (a) sending ZEPHALTO information and offers via Email and/or SMS, (b) the recording of requests, (ii) any retention period imposed by law; or (iii) at the end of the limitation period applicable following a dispute or investigation which could arise in the context of the operations concerned, unless a prior request for deletion is sent to contact@zephalto.com.
At the end of the period considered, the Personal Data communicated by the User will be destroyed, in accordance with the applicable regulations.
8. Evolution of the Charter
ZEPHALTO reserves the right to make any modification or update to this Charter at any time (in particular due to legislative and/or regulatory developments).
If a modification or update is made to the Charter, ZEPHALTO undertakes to publish the new version on its Site.
